Mauritius Freeport Development Company Ltd, hereinafter referred as MFD is a company incorporated and registered in Mauritius under the Companies Act on 21st August 1995 and operates under the laws of Mauritius. MFD provides distribution and industrial logistics services for local, regional, and international markets, having its registered office situated at Freeport Zone 5, Mer Rouge, Port Louis, Mauritius.

MFD is committed to the protection of your personal data and privacy in compliance with the Mauritius Data Protection Act 2017 and has published this Privacy Policy to inform you about your privacy rights.

2.0 Terminologies

For the purposes of this Privacy Policy, the meanings of data controller, data subject, data processor, and personal data are defined in accordance with the Data Protection Act 2017:

means a person who or public body which, alone or jointly with others, determines the purposes and means of the processing of personal data and has decision making power with respect to the processing.

“Data Subject”

The personal data collected, retained and processed by MFD includes but is not limited to the following:

  2. Personal data collected by cookies on our website.
  3. Any other personal data necessary to reply to your query.
  4. Any other personal data that you choose to provide us.

4.0 Why do we collect, retain, and process your personal data?

We collect your personal data for specific purposes when you complete the contact us form or applications, in order:

  1. to respond to your queries;
  2. to provide you with services;
  3. to manage and ensure effectiveness of our websites;
  4. to track interaction of users on our websites.

5.0 On what legal basis do we process your personal data?

Any personal data that is provided to us by you, e.g., during query of our services or joining our mailing list, will be based upon your consent.

Any information that we use or process to ensure the effectiveness of our websites and troubleshoot any issues and/or monitor interaction of users on our website, will be based on our legitimate interests.

Some information is collected through our server log which includes users’ IP addresses and, web pages visited. This is necessary to manage our website and troubleshoot issues which are/may be encountered.

We also use Google Analytics, which is a service provided by Google Inc. to grasp engagement of visitors and/or users on our website to improve user’s experience and, to understand how well our website is faring.

MFD may make use of your personal data for marketing purposes such as sending you information on promotions and services. Your consent will be required for such purpose and at any time you may withdraw this consent by contacting us on: dpo@mfdgroup.mu.

8.0 What is the retention period of your personal data?

Your personal data will be retained for as long as is necessary for the intended purposes for which it was collected, including for any other requirements to be satisfied with the authorities. MFD will take the necessary steps required to delete such data when the purpose(s) for which it was collected lapses. Personal data for which retention is no longer necessary will be discarded.

10.0 Is personal data collected, retained, and processed by us transferred outside Mauritius?

Personal Data collected by MFD shall not be transferred to another jurisdiction unless it is an equivalent jurisdiction as per the Data Protection Act 2017 and the EU General Data Protection Regulation, which provides a comparable level of protection of the Data Subjects’ rights.

11.0 What are your rights in relation to your personal data?

As a data bubject, your rights are safeguarded under Part VII of the Data Protection Act 2017 regarding your personal data, which include but are not limited to:

  1. Right of access, request rectification and erasure of your personal data.
  2. Right to restrict the processing of your personal data.
  3. Right to object to processing of your personal data.
  4. Right not to be subject to a decision based solely on automated processing of your personal data, including profiling, which produces legal effects concerning you or significantly affects you.

12.0 Do you have the right to withdraw your consent to process your personal data?

Your consent is understood to be explicit, informed, and unambiguous indication by the usage of our website and clicking on the “Ok” option, by which you signify your agreement to your personal data being collected, retained, and processed. Where you are required to consent before browsing our website and you proceed without doing so, it will be considered as implied consent.

You have the right to withdraw your consent at any time by emailing us on: dpo@mfdgroup.mu and request for a full erasure of your personal data from our server. Your request shall be fully satisfied unless MFD has any other lawful basis to process your personal data, for which you will be notified in writing on email within 48 hours by the MFD DPO. In the affirmative, your personal data will be deleted from our server within 3 months.
